Home / Guides / Why Mailchimp, Constant Contact and Brokerage Email Tools Don't Work for Cold Email

Can you use Mailchimp or Constant Contact to email homeowners?

Short answer: Not for cold email. Mailchimp and Constant Contact are excellent for newsletters to people who opted in, like your sphere and past clients. Their own policies prohibit purchased, third-party or scraped lists. Emailing neighbors who never subscribed needs a tool built for cold email, with its own data and paced sending.

What these tools are great at

Mailchimp, Constant Contact and the email features inside brokerage and CRM suites are built for opted-in audiences: past clients, sphere-of-influence newsletters, open-house sign-ups and drip campaigns to leads who gave you their email. Keep using them for that.

What their own policies say

ToolPolicyWhat it says
MailchimpAcceptable Use PolicyProhibits sending to "purchased, rented, third-party, co-reg, publicly available data, or partner lists of any kind" and requires evidence of consent
Constant ContactAnti-Spam Guidelines"A list of email addresses that has been purchased from a third party or scraped from the internet would not satisfy the affirmative consent requirement"
Brokerage / CRM email suitesVaries by vendorGenerally built for your own contacts and opted-in leads. Check your vendor's acceptable use policy before importing a cold list

What happens if you try anyway

Mailchimp says it may suspend or terminate accounts that violate its policy. Constant Contact says it may require a non-consent-based list to be removed, or ask the customer to find another provider. Either way, your newsletter account, which you need for your sphere, is at risk.

What cold email needs instead

  1. A fresh list of the right homeowners, built from public data and validated
  2. Name-matching to real inboxes, with scrubbing of active listings and recent movers
  3. Plain-text, short messages with a CAN-SPAM-compliant signature and opt-out
  4. Paced, human-like sending across managed accounts (Grassfed sends over 5 days)

Grassfed is built for exactly this. For a head-to-head comparison, see Grassfed vs Mailchimp.

FAQ

Is it illegal to cold email homeowners?

CAN-SPAM permits commercial email without prior consent if you follow its rules, but Mailchimp's and Constant Contact's own policies still forbid sending to non-opted-in lists on their platforms.

Can I upload a purchased list to Constant Contact?

No. Constant Contact's anti-spam guidelines say purchased or scraped lists do not satisfy its affirmative consent requirement.

Should I stop using Mailchimp?

No. Keep it for your sphere and past clients, and use a cold email tool for neighbors who haven't opted in.

What about my brokerage's email tool?

Most are designed for your own contacts and opted-in leads. Check that vendor's acceptable use policy.
